I have downloaded http://games.moria.org.uk/kye/download/kye-1.0.tar.gz
and unpacked the inside images.tar.gz to look for copied graphics.
Which graphics are copied ?

The text in res/xmaskye.xml is :

  This skin reproduces the look and feel of Christmas Kye Jr. Most sprites are
  from that game, others were adapted by Justin de Lucia.

So at first sight this seems copied code, yes.  However, on
http://xye.sourceforge.net/kye.php I read the following :

  I got a copy of this game which is freeware (It was called a christmas gift).
  It is kye but it has different sprites and an old school Christmas background.

Maybe these sprites were copied under the terms of some DFSG-free license.  To
be clarified.

What makes you think that ? Which graphics would have been copied ?

It is possible that some themes are simply part of the Xye project, so it
is not neccessarily a problem that we don't have a separate copyright and
license for each individual theme.
