So at first sight this seems copied code, yes. However, on http://xye.sourceforge.net/kye.php I read the following : I got a copy of this game which is freeware (It was called a christmas gift). It is kye but it has different sprites and an old school Christmas background. Maybe these sprites were copied under the terms of some DFSG-free license. It is possible that some themes are simply part of the Xye project, so it is not neccessarily a problem that we don't have a separate copyright and license for each individual theme.
