I think Peter's analysis is correct; if this is not used at all by default,
I don't think there's any reason to think that it's a license violation to
have it loaded into the memory space. If nothing that's covered by the GPL
uses the facilities of libssl, even indirectly, then this is no different
than shipping the GPL work and OpenSSL together on a CD.
