Thanks Charles. I didn't look for similar cases otherwise I would have found yours also recent which is really the same. As you did I should ask upstream to replace that file with another one because I don't want to build against it. Also excluding it from build process is (in my case) a working solution and the easiest way. And what about the second case without a license. Doesn't it matter? Does it inherit upstream license?
