Isn't this a kernel bug then and should be reassigned to linux-2.6? Today I tried to enable KMS on my laptop with self-compiled 2.6.30 kernel and ran into the same issue; it has also been discussed on [1]. Allegedly the patch in [2] fixes the problem, it is already part of the mainline kernel.
