I see this problem as well, though under somewhat different circumstances. I have an NFS-root system, and sometimes I chroot into it on the server and perform operations with apt (since this is far more efficient than doing it over NFS). It is not easily repeatable; usually a second attempt will succeed. It doesn't seem like an apt bug, but I haven't investigated it.
