My (WinXP SP2) msvcrt.dll has a 2004 date which will likely to be the latest one. It is more likely the DLL is using the function incorrectly. I've managed to generate errors in many Windows DLL's over the years.
Now, whats interesting is that I'm using the XPManifest component on my mainform which is then utilized by the DLL's to show their forms and components with XP themes. I just removed the XPManifest and the DLL does not now produce the error, but of course, my form and the DLL form looks ugly like Win98. I guess this DLL doesn't like XP Themes very much. However, under Winamp, this DLL does have XP Themes and works fine. I hope this may give a knowledgeable person a clue as to how I can solve this. I can't not use XP Themes.
