Well, Nick isn't a lawyer or a writer from what I can gather, as can be seen from his blog. Borland saying there is much great interest in buying their product is not a false hood. There are probably 1 million Delphi users who would love to buy it for $1. There are no Legal repercussions from such statements and Paul is correct.
In writing a Headline, the idea is to encapsulate the moment, or the day, or the past. Very few magazines speculate on future outcomes. As of the day he wrote the article, "no serious buyers" is completely true based on public knowledge. And public knowledge is all there is for a writer unless insider trading is happening. To add the word "yet" seriously weakens the headline and is potentially just as false. Paul knows today that there are no buyers. He certainly can't know what is happening tomorrow, so why put yet. I am amazed that Paul replied so often. I'm more amazed that someone would get overheated enough on a small issue to blog it like that. I see nothing in that blog that makes me thing less of the editor ;) His job is to portray his "opinion." Who the heck said his job is to state facts.
