Yes, my plan is to check the latest 3.8.x version of junit.jar into the 
repository, currently 3.8.2.

Since JUnit is CPL, and we are not planning on distributing it to users as a 
part of our distributions, it should be ok to just check junit.jar into the 
repository based on the guidelines in http://www.apache.org/legal/3party.html 
and what other projects are doing. The CPL is classified as a Class B license 
in the aforementioned guidelines and since we are not redistributing it to the 
Derby user community, I don't believe that we need to include a pointer to the 
junit source in our NOTICE file. Anyone with a different understanding of the 
issue should feel free to correct me on that.
