No, if I understand your question correctly, the tests that lack the permission 
(in ServerPropertiesTest) are not aware that there is any JMX or MBeans in play 
at all, so they should not fail, because they are not testing it. This issue is 
(as I understand it) a side-effect of DERBY-3429, that the JMX features are 
enabled by default when using a good enough JVM. The JMX tests themselves use a 
different server policy (a default one), with all the required permissions, 
while the ServerPropertiesTest tests use a special policy (for various reasons) 
that did not include these permissions.
