For Gtalk, at least, I believe this is not an issue with Empathy but with the method Gtalk to implement invisibility, as Curtis Lee mentioned. Unfortunately, switching to Pidgin will not solve resolve this as there is currently a similar bug: http://developer.pidgin.im/ticket/5828.
