I detected it on Precise, but confirmed it on Quantal beta1. I also have a Precise + Gnome-shell installation using Adwaita as theme, on where I can see the same problem. Lets hope is not a limitation on Nautilus.

Split pane using the F3 key. Click on an empty area on any pane. Both panes look the same, and its difficult (if not impossible) to know which panel is the active one. If you have a folder or a file selected, you can use the selection indicator to get a clue, but even in this situation you can miss it and operate on the wrong file/folder.
