Window controls should not come up on the panel when an application is
not maximized. This is intended behaviour according to the design spec.

Marking opinion; feel free to discuss and state why you feel window
controls should appear and the application name should disappear
completely when hovering over the panel in this state.

Bug description:
  When file manager is open and NOT maximized, if I hover with the
  mouse, on the menu in the top bar, it only partially overlaps
  applications description/name leading to an unestetic overlap effect.

  Expected: Close/minimize buttons should appear like when application
  is maximized,
