ok, from IRC discussion, the same happens when doing a direct dbus call:
"dbus-send --print-reply --dest="org.gnome.Nautilus" /org/gnome/Nautilus
org.gnome.Nautilus.FileOperations.EmptyTrash"
so it's not a unity issue in any case
the problem also is that a nautilus view is opened when it shouldn't

This is since I've upgraded to Raring.
Click empty Rubbish bin
it opens up Nautilus but doesn't show you the rubbish bin - it shows
you you home directory.
