The case I had in mind is a file with a modification time in the future (e.g. clock skew or a mounted volume), which currently produces a Last-Modified later than Date. RFC 9110, section 8.8.2.1 explicitly requires replacing that value with the message origination date. The fix is about 15 lines in DefaultServlet, with regression tests, and leaves the resource metadata unchanged. I understand if this is considered too marginal to address.
