I would think that it would be much more preferable to take the possibility of mistakes like these out of developer's hands if you can. Most developers will probably not bother testing the app on all platforms, thinking "well it probably would work on Android", and end up ticking the box anyway. Even I probably would, expecting the Marketplace to do final sanity checks against permissions, etc.
