I think it simply needs a better explanation from whoever sets to P1/P2 as to why they think it deserves to be set at that level. Simply stating "Regression" tends to indicate that any bug not found in the previous release will be consider by that developer as a P2 candidate.
With some better description it forms the start of a dialogue that can continue on that issue. Linus can always get involved to make some final decision if there's serious disagreement.
