I don't know of an actual failure this is causing but code appears to be a bug.
ResolveContext.java as part of the findProviders call has a helper
addValidCapabilities(). If asked to validate on the first non-Valid capability
encountered, it will return rather than continue to check all Capabilities
passed into it to evaluate.
Also when adding dependencies from RepositoryServiceRepositories the
implementation seems to incorrectly enable validation of sharing path.
