In this case no problem to release with bug 26753 still open, you're right. But shouldn't we add prominent warnings to such issues, a link on the welcome page or something?
I haven't been able to reproduce the page corruption with the 2.1.3 release, but I have experienced a complete lockup, details at

I'll do some tests now with the current CVS and excalibur-store-20031211.jar as suggested by Joerg.
