As it was already pointed out that does not work without excesive serialization/desriazlization due to the nature of xmlbeans 1.x. In principle xmlbeans 2.0 would support DOM directly but the current xmlbeans development is far from a stable version.

As far the stability/cavites in the implementation, then searching https://bugzilla.mozilla.org/query.cgi with product=Rhino and componnet=E4X should give the list of currently open E4X issues in Rhino:
