There was only o.a.c.util.jxpath.DOMFactory, and I added BindingJXPathFactory this morning to merge DOMFactory and your code. That's why you missed its existence ;-)
Works for me using DOM (the sample is no more broken). Can you cross-check with collections so that we can declare the showstopper solved?
