So it is not legally clear, for example, if the ASF would be allowed to take that data and move it to a different forge without consent from authors.

There is no legal uncertainly on that point. The ASF is free to move any ASF project data (including source code) to any hosting location of the ASF's choosing without any need to seek permission from any other entity.
