The first thread suggests that a specially licensed version of the library, without the problematic clause, was obtained by the ASF. Was that special version used for the embedded copy used in WebConsole 3.x? For 4.0, the org.json package is no longer embedded, so consumers who care about this licence will have to separately obtain the specially-licensed version, assuming they can find it. Irrespective of whether this clause is technically incompatible with the ASL, I know that several organisations I work with cannot accept it. One of those for example is the Eclipse Foundation. I would have a strong preference for replacing the use of this library with a more sensible alternative.
