I think his point is that his code worked in 4.9.1. With the extra check introduced in 4.10, he gets an exception. That's a regression.
If we decide the benefit of the new check is bigger than the loss of backwards compatibility, we need to at least note this in RELEASE_NOTES and preferably offer a workaround.
