I guess in the literal sense, it /is/ an unavailable service, so 503 would
be a more ... diplomatic response :) . I think of it as something that's
self-correcting ... corrected when the server load drops and mod_cgid can
begin to keep up again.

so, eh. I suppose it's more of how people feel about such things.
Personally, I'd go for 503. 500 is overloaded imho and maybe a bit
ambiguous in this case.
