Perhaps I have selected the wrong place to fix the issue I am seing then.

If I do a query

SELECT * WHERE {
{SERVICE silent <A> { ?m a <foo> }}
UNION
{SERVICE silent <B> { ?m a <foo> }}
}

And A has no answers, B has an error (failed service) I get a single empty 
result.  If I have more services that fail I get as many empty results as there 
are failed services.  With the patch I get an no solutions (as expected). 

Should the solutions with no bindings be filtered out somewhere or should I 
just do it in my code?
