Hmm that is really strange... if I take the <br /> tag out of the text in
the DB it is fine, but if it is there it complains.

Forta's book says that XMLFormat() is to escape  ampersands (&), double
quotes ("), greater-than signs (>), less-than signs (<), and single quotes (')
so that they are safe in XML - which is what happens in WDDX isn't it?

Doesn't that suggest that those characters aren't safe unless escaped?

Are you certain of this?  We WDDX HTML data all the time, and never need
to treat it specially.
