I used to think that you could not get round this as flash kind of floats above everything else as it is an embedded object. But then as I saw the relaunch of www.adobe.com after the macromedia aquisition and it appears they know how to do it as their drop downs go over the swf. I keep meaning to have a dig around their CSS and JS to work it out but alas I have been busy, might be worth a look.
