It should be open - it is based on debian, the most open of linux distros (aside from GnewSense.) But a Moblin based on any operating system that has APT might as well just be based on debian, like Maemo is. Nokia has already done a lot of the work on making the libs nice and optimized for embedded environments and has ported Qt and GTK+.
