Yes, it would be way easier if the donation documents used firm language 
without any conditionals. However, I am afraid that isn't possible (unless 
Apache loudly refuses the donation and accuses Oracle of not acting fair). 
Moreover I have just heard an explanation why the Oracle position is correct:

When you get some amount of money, do you count them or do you trust the other 
person to give you the right amount? I try to count them. When I am giving 
money I encourage others to count them as well. It isn't a matter of trust, it 
is a matter of verification. Everyone can make mistakes, but when we work 
together to avoid them, we can solve them openly before we start to be 
suspicious of each other.

I believe we can interpret the sentence in the donation document by Oracle as 
an encouragement to Apache foundation to "count". Just like I am asking others 
to count my money, we (Oracle) are asking us (Apache community) to verify we 
are OK with the donated source files.

I know it is not a simple task, but I think it is doable. Automatic conversion 
of well known Oracle license headers to Apache (as suggested by Jan Lahoda) 
and excluding well known exception (manifest.mf files and *.form files) is, in 
my opinion, a great way to start and reduce the amount of work.

Bertrand, our mentor, please help us do the "counting" or loudly refuse the 
donation, if "counting" isn't acceptable way to verify donation to the Apache 
Foundation.
