Selenium licence problem ?

I have posted some comments in 
http://forums.openqa.org/thread.jspa?messageID=18368&#18368 about this problem. 
I wonder now if I'm not mixing 2 facts/problems.
We (OFBiz commiters) must not mix third works with incompatible licences with 
our work. But is that a requirement also for projects outside of ASF ?
