license of the binary file; are we allowed to create one and license it

I'm not sure about the issue you think about. If I refer at https://github.com/gradle/gradle/issues/2852 there should be no issues. It's plain ASL2
licensed like all the rest of Gradle, isn'it?
The users will possibly download it after they downloaded the package.
Do I miss something?
