ah, if only it were that simple :-)

the API uses a hash and disallows repeated tags on ways and relations.
but it uses a list for nodes, so you can easily get duplicate tags by
the method you describe.

duplicate keys are made unique by adding a postfix number. an extra
tag is also added, so that the modification is documented and can be
searched for.
