If you're talking in your role as a maintainer of Merkaartor, then the fails gracefully bit is a good idea, but you don't need to avoid using the services. Mappers editing the data are the intended audience for the services on openstreetmap.org, so Merkaartor is meant to be using them.

A problem only arises where a third party, end-user application starts using what are effectively mapper's tools to provide a service to its users, and fails to identify itself to OSM sysadmins in the process. None of these issues is true of Merkaartor.
