It is actually after 
PHOENIX-3396(https://github.com/apache/phoenix/commit/a54a06cf566363054778dc60431553c6384ef34d).
 There is a typo error while enclosing IF blocks.

And, on a similar area(PHOENIX-541), MutationState#getMutationBatchList method 
doesn't fit well in UngroupedAggregateRegionObserver. As we can't collect all 
the mutations and form batches later for commit. 

Attached patch should fix the above two problems, 

but It exposes another unit test failure 
ImmutableIndexIT#testCreateIndexDuringUpsertSelect, where Index created will 
not see in flight batch of another UPSERT SELECT.
