XMLBeans is a volunteer project without many active volunteers. For one, we 
won't be reverting changes made over 4 years ago.
If you want to experiment with fixing this yourself, someone may have time to 
review your changes.
The XQuery support is not widely used and this might be why noone has run into 
this yet.
