You're quite right, there was a race condition there alright. It was hard to
repro on my box, possibly because I'm running linux kernel 2.6.x -- but it's
there.
I implemented a separate patch based on your report to avoid requiring a CLA be
signed. (also added a test case t/ script)
checked in as r157633. patch attached for 3.0.0 users.
