Iassume it's due to the fact that .foo is a new TLD 
(http://data.iana.org/TLD/tlds-alpha-by-domain.txt)

example.foo has no whois

if .foo is used as a fake TLD, usage of .foo should probably be replaced by
something else
Could someone please verify this?
