We definitely want these files in the top level of any distribution
artifacts, to meet the requirements.  I also suggest, however, that we
ensure they are inside every JAR file we create as well ... that way,
when a user downloads Struts and starts using it, and six months later
their PHB asks "what are the license terms for that arbitrary JAR file
that you grabbed from someplace we don't remember?" the question can
easily be answered by looking inside.
