It appears that "Pelikan Text-Marker" had been trademarked but not extended and
did not apply for software [1].
It appears to me that the German preference to call marker pens "Textmarker"
comes from that product (cf. "Tempo" for paper tissues). In other countries,
apparently other names are more popular [2].
"TextMarker!" is a Firefox Plugin [3].
"Textmarker" appears to be a function in the German version of Microsoft Office
[4].
I am by no means a legal expert, but it appears that the term has become
commonplace in German and appears to be no longer protected (at least in the
"pen" sector). A search on Google reveals that products by different vendors
(e.g, Pelikan, Stabilo, Edding, etc.) are advertised as "Textmarker". They
carry additional trademarked names such as "BOSS", "Textsurfer", "NAVIGATOR",
etc.
