If you plan on cutting a release before the licensing issues are targeted, I would strongly encourage you to use the new WIP notice version: http://incubator.apache.org/policy/incubation.html Otherwise your release will be killed on the incubator mailinglist.
The WIP Disclaimer allows projects to settle and start releasing things, but if the issues are not resolved, the project will never graduate. I would strongly advise to not use the WIP disclaimer and use the normal one after having sorted out the licensing issues ... you only have to do this once, once everything is ok, it's a lot less work to keep it that way.
