Currently the Jahia source code repository is the same for all versions. Certain classes are available under the free open source CDDL license. Others are available under the more restricted "sustainable license" (basically the same text but which enforce a strong quid pro quo paradigm = a contribution in cash or in kind in order to use those classes in production).

So yes you can download and compile the whole SVN repository free of charge. However you do not have the right to use in production certain GUI or classes (those released under the JSSL license) without paying your contribution due (through a cash license or through additional developments, translations, etc....).
