It may be a good idea to ping the author of this app and give them a heads up. 
This doesn't look malicious to me. I believe the author here probably doesn't 
realize this is a problem, and likely will be very surprised by the apple legal 
nasty gram. 

To put it another way, I have a saying. "We're better people than that.". While 
it is rude to use a copied icon, it's still polite to give them fair warning. 
Everyone on this list would likely appreciate fair warning for a harmless act 
such as this.
