That disclaimer is obviously a direct violation of Section 6
of the GPL, and renders the email (the patch) non-free, and
legally undistributable as the combined license contradicts
itself (Section 6 says there may not be any further restrictions,
while the disclaimer adds restrictions).

I don't know how kernel.org people deal with that, but I
consider this problematic.
