Is there anything stopping the ISPs implementing a policy of "Sure;
we'll terminate anyone found guilty in a court of law of copyright
infringement, or who has had damages from them relating to copyright
infringement in a civil suit. Just show us the paperwork and we'll
turn them off in 24 hours."?
