Yes, there was a licensing issue, with the folks at SSH Communications,
who originated the ssh protocol, putting  further licensing restrictions
on the use of their version of ssh.  In response, the OpenSSH project
came about.  The history of the project is at:

I would also note that OpenSSH (which we include in the e-smith server)
*does* support both the SSH1 and SSH2 protocols, so either can be
used.
