Thank you. This was a good read, though I don't have all the references
to look at where I am (and for the forseeable future). I was looking at
the whole concept from a separate perspective - Intellectual Usability -
and have a paper on a hard drive in the Dominican Republic (the joys of
moving around) that was accepted for FISL last year. Unfortunately,
because of some issues related to getting to Brazil last year, I could
not present it. However, I will be modifying it in the next year or so -
I expect to be back in Dominican Republic sometime around October.

Instead of discussing the property angle - which lawyers are better able
to discuss - I thought tackling how usable something is would be an
interesting thing to consider. Since property has no value unless used,
it's an interesting thing to consider. Then discussions on the Free
Software Business list regarding patents, and this list and others
regarding Open Content, have spawned a whole bunch of notes I have to
integrate still. I'll probably end up referencing your paper as well.
