I am having a similar problem trying to get Xcode 4 for Snow Leopard. Clearly Apple's policy is that anything other than currently purchasable hardware is out-of-date legacy and should be immediately disposed of, to be replaced with something new and shiny. Not what I would call quality customer care. Getting an Apple Developer account will almost certainly be necessary to get Xcode.
