I agree that ... IF ... and, it is a big IF at this point ... that you could
prevent the "hidden tx effect," this should solve the problem.

But what about existing modes such as Pactor I, II, and III? Can they do
this now? Or would they no longer be welcome on the amateur radio
frequencies?

What about voice detection? If you are going to operate based on BW, then
wouldn't some of the stations migrate to what is currently the voice area
here in the U.S. ?

Or should there still be a bandplan (not based upon FCC rules, but based on
general agreement) that the data digital modes stay in one area and voice in
another?

Or should all the data modes of the same BW stay together and keep analog
signals separate?

My concern is that we still won't be able to mix voice (whether analog or
digital) with data and image on any given frequency. Right now the only HF
band you could do it (but probably go against the current voluntary
bandplan) is on 160 meters.

I, actually, do not agree that there is a need for more new restrictions...
nor do we need to further restrict the automatic and semiautomatic modes...

...it is now possible to write software to detect channel busy
situations...for example, the new SCAMP mode (which is now officially in
beta testing as of 2.04.05) has such software which will detect the presence
of intelligence on a channel and prevent transmission...it works effectively
for most modes (CW,PSK, RTTY,MFSK, PACTORI) except for high entropy modes
such PACTORII and III.... so most, if not all, of the current source of
complaints can be eliminated in software..

......enshrining more restrictions in regulations (to handle a problem that
has now been solved) will only continue the current overregulation
regime...and will do nothing to help US Hams regain the lead in inovation
that we have ceded to the rest of the world by our outmoded regulatory
regimes.
