As my dad used to say, "You can do whatever you want as long as you are willing to face the consequences". So go nuts. If you aren't interested in FCC fines, then yes, you have to abide by FCC rules, with the RFX900 you can transmit safely in the ISM band. And others as long as you are below the transmit power thresholds (which are quite low). To find out the rules about where you can and can't transmit you should check http://www.fcc.gov/oet/spectrum/ specifically, check the "Frequency Allocation Table".
