I ran into this myself:

Yesterday morning:.

   Domain Name: <DOMAIN IN QUESTION>.COM
   Registrar: NETWORK SOLUTIONS, INC.
   Whois Server: whois.networksolutions.com
   Referral URL: www.networksolutions.com
   Name Server: NS1.GALSTAR.COM
   Name Server: NS2.GALSTAR.COM
   Updated Date: 14-nov-2000

after seeing this, on Monday AM, I registered the domain with OpenSRS, (It
showed as available at opensrs and NSI's sites, so I registered it)  and
this was still in whois until this morning when I saw this:

   Domain Name: <DOMAININQUESTION>.COM
   Registrar: TUCOWS.COM, INC.
   Whois Server: whois.opensrs.net
   Referral URL: www.opensrs.org
   Name Server: NS1.CENTRALINFO.NET
   Name Server: NS2.CENTRALINFO.NET
   Name Server: NS1.KNAB.ORG
   Updated Date: 20-nov-2000

Just because a domain shows in whois as taken doesn't mean it is.
